Terms of Service

1. Acceptance of Terms

By creating an account or using chatit (the “Service”), you agree to these Terms, our Community Guidelines, and our Privacy Policy. If you do not agree, do not use the Service.

2. Eligibility & Account

  • Age. The Service is for individuals 13 years and older.

  • Campus access. We primarily serve U.S. university communities and may require .edu email verification or similar proof of affiliation.

  • Your responsibility. You are responsible for your account, device, and keeping your password secure. One person → one account; no account sharing, selling, or renting.

3. User Content & Limited License to Us

  • You own your content. Text, images, media, and other materials you post are “User Content.”

  • License to operate the Service. You grant chatit a non-exclusive, worldwide, royalty-free, transferable and sublicensable license to host, store, reformat, display, distribute, and create non-substantive adaptations of your User Content solely to operate, promote, and improve the Service (including moderation, safety, backup, and indexing).

  • Deletion. When you delete content or your account, we remove or de-identify it within a reasonable period. Copies may persist in backups, logs, or where others have re-shared your content, as permitted by law.

4. Acceptable Use (follow our Community Guidelines)

You may not use the Service to:

  • Break the law or facilitate illegal/dangerous activities (e.g., drugs, weapons, forged IDs, instructions for crime).

  • Harass or harm others; threaten violence; engage in hate or discrimination against protected classes; dox or stalk others; share non-consensual intimate imagery (NCII); or involve minors in sexual content (CSAM strictly prohibited and reported).

  • Violate academic integrity (selling/buying exam questions, answer keys, paid homework/essays, coordinated cheating).

  • Infringe IP (copyright/trademark), impersonate others, run scams or phishing.

  • Spam/manipulation (mass posts, link farming, engagement manipulation, scraping, crawling, reverse engineering, attempting to bypass rate limits).

  • System abuse (bots, scripts, unauthorized API calls, packet capture or unusual repeated requests; accessing or probing non-public areas; interfering with service stability).

  • Privacy violations (sharing someone’s personal data or recordings without consent; hidden-camera content).

  • Commercial promotions outside allowed areas; account sales/sharing are forbidden.
    We may remove content or restrict accounts to protect users and comply with law.

5. Promotions & Commerce (summary)

Promotions are limited to designated areas (if enabled). No gambling, adult services, credit cards/insurance/medical ads, or deceptive recruiting. Campus jobs/events must be legitimate and clearly labeled. See Guidelines for details.

6. Moderation, Reporting, and Appeals

We use a combination of automated tools and human review. We may remove content, limit features, or suspend/terminate accounts (warning → temporary suspension → permanent ban, depending on severity).

7. Takedowns: Privacy, Defamation, NCII

If content violates your privacy/publicity rights, is defamatory, or includes NCII, report it in-app or email jxlove2004@gmail.com. Provide URLs, a description, and any proof. We will act where appropriate, which can include removal and account restrictions. CSAM indicators are immediately escalated to NCMEC/law enforcement.

8. DMCA Copyright Policy

If you believe your copyright is infringed, send a DMCA notice with the elements of 17 U.S.C. §512. We may forward your notice to the user and accept counter-notices. Repeat infringers may be terminated.

9. Ads, Tracking & Analytics (personalized ads enabled)

We use Google Mobile Ads (AdMob) to show ads and Firebase Analytics/Crashlytics to improve performance.

  • iOS ATT. We request AppTrackingTransparency consent before cross-app tracking for ads.

  • Opt-out (US state laws). California: Do Not Sell or Share My Personal Information (cross-context ads) in Settings → Privacy. Other states with similar laws: Opt-Out of Targeted Ads. If you opt out or decline ATT, we serve non-personalized ads.

10. Third-Party Services & Links

The Service may link to or integrate third-party sites or SDKs. We are not responsible for their content, terms, or privacy practices. Your use of third-party services is at your own risk.

11. Service Changes & Availability

We may modify, suspend, or discontinue any feature to protect users, comply with law, or improve performance. We will provide notice where required (in-app or by email).

12. Termination

  • By you. You may delete your account at My Page → Delete Account.

  • By us. We may suspend or terminate your access for violations, risk to users, or non-use. Certain sections survive termination (e.g., licenses as needed for backups/defense, disclaimers, limitations, DMCA, dispute provisions).

13. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED (INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND NON-INTERRUPTION).

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED, WE SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR LOSS OF PROFITS/GOODWILL/DATA.
OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE SHALL NOT EXCEED THE GREATER OF USD $100 OR THE AMOUNTS YOU PAID TO US (IF ANY) IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY.

15. Indemnification

You agree to defend, indemnify, and hold us harmless from third-party claims arising from your User Content, your violation of these Terms, or your violation of the law.

16. Governing Law & Venue

These Terms are governed by the laws of the State of California, excluding conflict-of-laws principles. You and Chatit agree to the exclusive jurisdiction and venue of the state and federal courts located in San Francisco County, California.
(Prefer individual arbitration & class-action waiver instead? Tell us and we’ll switch this section to an AAA arbitration clause with a 30-day opt-out.)

17. Notices & Communications

We may provide notices via in-app messages or to the email associated with your account. You consent to receive electronic communications.

18. Changes to Terms

We may update these Terms to reflect changes to the Service or law. We’ll post the Effective Date and, for material changes, provide notice in-app or by email. Continued use after the effective date constitutes acceptance.

19. Miscellaneous

These Terms (with the Privacy Policy and Community Guidelines) are the entire agreement between you and us. If any provision is unenforceable, the remainder remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our prior written consent.

Security & retention

  • Data encrypted in transit: Yes

  • Data deletion request available: Yes (My Page → Delete Account; email requests accepted)

  • Retention: Until purposes are fulfilled or legal obligations end; deleted upon account deletion (minimal security/legal records may be retained).

Google Play Child Safety Standard Policy Summary

 

Google Play's Child Safety Standard Policy mandates that apps categorized as Social or Dating must adhere to strict guidelines against Child Sexual Abuse and Exploitation (CSAE) to maintain platform safety. Compliance is required for all developers in these categories, regardless of whether their app is aimed at adults or has age restrictions. Key requirements include publishing clear standards on CSAE, providing an in-app reporting mechanism for user feedback, actively working to eliminate Child Sexual Abuse Material (CSAM), complying with all relevant child safety laws, and designating a specific Child Safety Point of Contact. Developers must submit a mandatory Declaration Form starting in December 2024, with a final deadline for full policy compliance by March 19, 2025. Failure to comply by this date may result in the app's removal from Google Play.
